The EU Whistleblower Directive: What to Expect?

EU Member States need to implement the EU Whistleblower Directive into national law by December 17, 2021. Currently in the EU, whistle-blower’s protection is heavily fragmented across the EU Member States. The Directive aims at creating a certain minimum level of harmonized rules across all 27 EU Member States while at the same time giving Member States the right to extend the scope of the Directive by more favourable provisions.

The Directive requires businesses operating in the European Union to meet a certain threshold, which on some topics goes beyond what is currently known as the market standard. Global businesses operating in the European Union will need to examine their existing whistleblowing policies and procedures against what is contemplated under the Directive and respective national laws.
